1. Who these terms are between
These terms are between Lewis Forecourts ("we", "us") and the business purchasing advertising ("you", "the client"). They apply to the client area of this website and to the advertising service it manages.
2. The service
We display your advertising media on digital screens at our forecourt locations, according to the package agreed with you. Your package sets which locations and which screen types your advert appears on, and how many adverts you may run at once.
We schedule adverts on a rotation shared with other advertisers. We do not guarantee a particular number of plays, a particular position in the rotation, or a particular audience figure unless we have agreed that with you in writing.
3. Your advertising media
You are responsible for the content of everything you upload. By uploading you confirm that:
- you own the rights to it, or have permission to use it;
- it is accurate and not misleading, and complies with the UK Code of Non-broadcast Advertising (the CAP Code);
- it does not infringe anyone's rights, and is not offensive, discriminatory or unlawful;
- it is suitable for a general audience including children, since our forecourts are public.
We may refuse or remove any advert we reasonably consider unsuitable, unlawful or damaging to our business. Where we do, we will tell you why and refund any unused portion for that advert.
4. Technical requirements
Media must meet the published size, format and duration requirements for each screen type. Uploads are checked automatically and anything that does not meet them is rejected at the point of upload with an explanation.
5. Payment
- Fees are as set out in your package and are payable monthly in advance unless agreed otherwise.
- Payments are taken through Stripe. You may pay each month manually, pay one month ahead, or set up a recurring payment.
- If payment is not received by the due date plus the grace period, we may suspend your adverts until it is. Suspension does not extend your paid period.
- All prices exclude VAT unless stated otherwise. VAT is charged where applicable.
6. Cancellation
You may cancel at any time from your dashboard. Cancellation takes effect at the end of the period you have already paid for, and your advert continues to run until then.
We do not refund payments for periods already paid. This is stated at the point of cancellation and you must acknowledge it before cancelling.
We may end the agreement by giving you 30 days' notice, and will refund any period paid for but not delivered.
7. Availability
We aim to keep the screens running during our sites' normal opening hours. Screens may be off for maintenance, power or network faults, or circumstances outside our control. Short interruptions are part of the service and are not refundable. If a screen is out of action for more than seven consecutive days, we will credit you pro rata for that screen.
8. Your account
You are responsible for keeping your password and two-factor device secure, and for everything done through your account. Tell us immediately if you think someone else has access. Do not share your login.
9. Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Subject to that, our total liability in any 12-month period is limited to the fees you paid us in that period, and we are not liable for lost profits, lost business or lost goodwill.
10. Changes
We may change these terms by giving you 30 days' written notice. If a change materially disadvantages you, you may cancel within that notice period and we will refund any period paid for but not delivered.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
